General Body Meeting of AIBSNLEA, West Bengal Circle on 23.09.2017 at T.I.Hall, CTO Building, Kolkata
A General Body Meeting of AIBSNLEA, West Bengal Circle was held on 23.09.2017 in the T.I.Hall, CTO Building, Kolkata in the presence of Shri Prahlad Rai, GS & Shri Shiv Kumar, President, AIBSNLEA CHQ, New Delhi. The hall was fully filled up with the AIBSNLEA Members. Shri Prasun Mukhopadhyay, O.S.(East), Shri Basudeb Chakraborty, Adviser, CHQ, Subhasis Mitra CS CTD, were also present in the meeting. Shri Prasun Mukhopadhyay requested the GS to take up the various issues of CTD & W.B.Circle with BSNL HQ for early settlement. Shri Aniruddha Basu, CS, West Bengal Circle, Shri Prasanta Nag CS, AITEEA, Subhasis Mitra CS CTD, S. Sarkar CS, Retired Association delivered their valuable speech. Shri Shiv Kumar, President, CHQ stated that this is his first meeting with the Members of West Bengal Circle. He explained in details the problem being faced by CHQ due to opportunistic approach of some sister Unions/Association. Shri Prahlad Rai, GS explained in details the status 3rd PRC issue, 15% fitment benefit, status of CPC of various cadres, transfer related issue of Accounts Cadre, deduction of GPF contribution on actual basic pay, non-deduction of additional increment benefit in respect of EPP from pensionery benefit of retired employees, continuance of dual membership by SEWA members. He requested to the AIBSNLEA Members of CTD & West Bengal Circle to work more actively to upgrade the status of CTD & WBTC like Orissa, Ketala Circle. Shri Kalyan Halder, President, AIBSNLEA, WBTC conducted the whole meeting smoothly. In his speech he stated that CCA, DOT is deducting additional increment benefit from the retirement benefit of employees and this should be stopped immediately. He conveyed vote of thanks and finally concluded the meeting with national anthem.

High Court of Kerala uphold FR 22.1.a.1 fixation for O-JTOs
On 15-9-2017 Hon.High Court of Kerala dismissed WPC 23407/10 & 23850/10 filed by BSNL against the CAT Ernakulam order granting legitimate fixation under FR 22 1(a) 1 to officiating JTOs .
BSNL filed 14 writ petitions in HONBLE Kerala High court against the FR 22 1(a) 1 pay fixation of officiating JTOs . From year 2010 onwards these cases are pending with this court . During this period officiating JTOs of other circles filed for FR 22 1(a)1 protection cases . For all these cases favourable judgment were received from PCAT New Delhi. However, BSNL filed appeal in high court of New Delhi . New Delhi high court dismissed this appeal with remarks that it is subject to the outcome of pending cases in high court ofkerala . BSNL again went to supreme court . Supreme court also dismissed this SLP and made same remarks that the outcome of the case is subjected to the verdict of kerala Highcourt. Finally 15/09/2017 Honble kerala high court dismissed all 14 petitions with FR 22 1 (a) 1 . Now all officiating JTOS are eligible for FR 22 1(a) 1 and no Recovery will happen further on this fixation already done .
Through this verdict Officiating service protection is also to be extended to the officiated services along with pending 78.2% fixation to all the erstwhile O-JTO comrades .

AIBSNLEA decides to participate in the demonstration call given by all BSNL’s Unions & Associations during lunch hour on 15th Sept., 2017 to protest against the creation of BSNL Tower Subsidiary Company.
All the District Secretaries of AIBSNLEA are requested to participate in same along with all the members.
A meeting of the CHQ Office Bearers and Circle Secretaries stationed at New Delhi was held at New Delhi to discuss and finalize the strategies regarding successful implementation of the proposed Organizational Action Program by AIBSNLEA on 04.10.2017. Also decided to invite nearby circles to participate in the “Candle March” on 04.10.2017. All the General Secretaries of BSNL Unions and Associations have been requested to participate and support the Organizational Action program.
All the District Secretaries are requested to hold their General Body meetings to mobilize the members, holding of press conference, press release, releasing posters, hand bills, banners etc for successful implementation of the Organizational Action program.

AIBSNLEA serves upon a Notice for organizational action programs demanding 3rd PRC implementation with 15% fitment benefits in BSNL to the Chairperson, Telecom Commission and Secretary (T), Department of Telecom, Govt. of India AND Chairman cum Managing Director, BSNL to launch following organizational action programs:
1. Memorandum to be submitted to the Hon’ble MPs (LS/RS) by all the Circle / District Secretaries immediately.
2. Holding of Demonstration on 04.10.2017 during Lunch / Closing hours at BSNL CO New Delhi, Circle and SSA Head quarters and submission of memorandum to His Excellency, Governor of the States, CGMTs and SSA Heads for recommending to the Hon’ble MoSC (I/C)
3. “Candle Light” march on 04.10.2017 at 18.00 Hrs from BSNL Corporate Office, Janpath, New Delhi to Jantar Mantar, New Delhi.

All the Circle / District Secretaries are requested to submit the Memorandum After demonstration to the His Excellency Governor / LG of the State and CMD / CGMT / SSA Heads. The Memorandum should be submitted to all the Hon’ble Member of Parliament of Lok Sabha / Rajya Sabha in their area immediately.
AIBSNLEA CHQ Delhi will organize a “Candle March” at 18.00 Hrs from BSNL Corporate Office, Janpath to Jantar Mantar, New Delhi in support of this demand.
We request all the BSNL Unions / Associations to participate and support the program.

6th Circle Conference of CTD will be held on 21/09/2017 & 22/09/2017 at Moulali Yuba Kendra, Kolkata. The open session will be commenced on 22/09/2017 at 3 PM in the same venue.
All members of WB circle are requested to attend this open session.

GS writes to the GM (Estt.) BSNL Corporate Office, regarding Implementation of Hon’ble CAT Principal Bench New Delhi Judgement in OA No. 3883/2014, MA No. 3364/2014 and MA No. 2265/2014- fixation of pay under FR 22(1)(a)(i) to the members of AIBSNLEA.
CS writes to GS, AIBSNLEA regarding Discrimination in transfer policy in respect of Accounts Cadre of West Bengal Telecom. Circle.
GS writes to the Director (HR), BSNL Board, regarding Non-implementation of executive transfer policy in West Bengal in case Accounts personnel.
This information is especially for the SC/ST employees of BSNL but can also be read by the other employees for enhancing their understanding and thus staying away from misleading information if any.
Based on recorded information:
1.On 18.03.2016, BSNL HQ Circulated the Model Guidelines for election at CHQ SEWA BSNL vide no. 65-8/2012-SCT. In which it states that the SC/ST Employee who become member of the SEWA BSNL should not be member of any other trade union.
2.Again on 07.06.2016, BSNL HQ Circulated the same Model Guidelines for election of Circle, SSA and district governing body of SC/ST welfare Association (SEWA) in BSNL vide no. 65-3/2015-SCT (Pt-II).
3.Disagreeing the above, BSNL Employees Union on 05.07.2016 vide their letter no. BSNLEU/200(REGN) had taken up the issue with BSNL HQ under the subject “DENIAL OF TRADE UNION RIGHTS TO THE SC/ST EMPLOYEES OF BSNL”.
4.Sustaining the objection, on 10.03.2017 BSNL HQ issued letter vide no. 65-3/2015-SCT (PT-I) under subject “Model guidelines for election of CHQ SEWA BSNL – Deletion of Sl No. 6, 7 and 8 regarding”. In this letter BSNL HQ categorically stated that items listed against the Sl no. 6, 7 and 8 of model guidelines under letter 18.03.2016 may be treated as deleted.
5.But on 22.03.2017 again CHQ SEWA BSNL immediately wrote to BSNL HQ vide no. SEWA BSNL/CHQ/GENL/2016-18 taking up this issue along with other issue in the form of Resolution like
“The Governing body meeting of SEWA BSNL resolved unanimously to strongly condemn the BSNL Management for deleting the provision i.e. 6,7, and 8 of SEWA BSNL By-Laws without the knowledge of CHQ which is highly illegal, unlawful, frivolous, and unwarranted……………”
6.In reply BSNL HQ on 26.04.2017 informed the GS SEWA BSNL vide no. 65-3/2015-SCT (Pt-I)/202 under mentioned subject “Request from SEWA BSNL For withdrawal of letter no. 65-3/2015-SCT (PT-I) dated 10.3.2017 and clarification thereto” ……………………… “However it is clarified that this office has not altered any provision in original Bye-Laws of SEWA BSNL and the matter has been referred back to the CHQ SEWA BSNL”.
From the above it is clear that SC/ST employees can member of a Trade union / Association as well as SEWA BSNL.
7.During this a lot of controversy and misunderstanding had been take place in between welfare Association and Trade Union/ Service Association. Ultimately BSNL HQ vide no. 65-1/2017-SCT/476 dated 31.08.2017 circulated to all CGMs and all SSA Heads the same letter which was addressed dated 26.04.2017.
The above point clearly indicates that the demand of SEWA BSNL rejected repeatedly. And thus now it very clear that SC/ST Employees without any hassle can be member of a trade union / Service Association as well as SEWA BSNL (SC/CT Welfare Association).
DOT circulated the stay order granted by Hon`ble Jaipur Bench of CAT relating any pay revision and any recoveries.

GS, President and AGS (Finance) met GM (Admn.) and discussed regarding settlement of some pending issues of BSNL pensioner’s viz. Non-payment of medical reimbursement (Without Voucher), Abnormal delay in payment of medical reimbursement (With Voucher), Tracking of Medical bills and formation of Pensioners Relation (PR) Cell. GM (Admn) after detailed discussions assured to take early steps for the settlement of above issues of BSNL pensioner’s.
